Family
of Sophie du Plantier plans to sue her
killer
- Private
investigation reveals details of
murder
- THE
family of Sophie du Plantier who was
savagely murdered in West Cork, six
years ago is actively considering
civil proceedings against the killer.
The family will take the case to the
European Court of Justice if the DPP
fails to act on a reinvestigation and
a new file on the murder, prepared by
senior detectives from Harcourt
Square. Senior Garda sources believe
that because the new file adds
nothing substantial to the original
investigation, the case will not be
recommended to go to trial.
A
detailed private investigation seen by the
Sunday Independent reveals that a man had
knowledge of the murder before it became
public. He told a number of people he had
committed the crime. He also told others
about the interior of the victim's house,
items on the kitchen table and furniture
layout which could have only been established
on the night of the murder.
Sophie du
Plantier's parents George and Marguerite
Bouniol and her brother Bertrand have
consulted lawyers at the highest levelin
France about instituting a civil action for
damages for the loss of Sophie, and they will
also be consulting Irish lawyers. Sophie's
husband Daniel Toscan du Plantier is expected
to join the action.
In
France, a successful civil action can result
in a criminal trial. In an Irish civil
action, a guilty verdict would preclude a
criminal trial. But if the civil action was
suspended, criminal proceedings could be
taken. The burden of proof in a civil action
is less than that in a criminal action with
the matter being proved on the "balance
of probabilities" instead of
"beyond all reasonable doubt".
While
financial compensation is the only outcome of
a successful civil action, as in the OJ
Simpson case, it may be the only option left
to the du Plantier family. The fact that this
is the likely result of one of the most
violent acts in the canon of Irish murder
(the victim sustained over 30 wounds and her
face was destroyed by a cavity block) could
be embarrassing for Ireland on an
international level. It will also, according
to a legal expert, provide further proof of
the shortcomings of our adversarial legal
system compared to the inquisitorial system
used abroad.
"The
French perception of Irish law, particularly
in the light of this case, is that the
interests of the criminal are more important
than those of the victim, and adversarial
justice is not sufficiently concerned with
the truth," says the expert. Relatives
of the Omagh bombing victims have instituted
civil proceedings along the same lines.
A private
investigation into circumstances surrounding
the murder of Sophie Toscan du Plantier
reveals that: A number of communications were
made by the killer suggesting a murder had
taken place in advance of the killing
becoming public. In the first of the calls,
he mentioned that a French tourist had been
murdered. This was before the body was
positively identified. The man revealed even
more damning knowledge of the murder some
days after the event. He approached a
neighbour of the victim who had prior access
to her house and asked if an unopened bottle
of champagne had been a gift or bought at the
duty free. The neighbour refused to divulge
any information. The man could not have known
that a bottle of champagne had been on the
table unless he had been in the house between
the time of the murder and the discovery of
the body.
Private
investigators interviewed a number of people
who made statements saying that on different
times and dates after the murder, a man told
them he had committed the crime. He told one
that "he had finished her off with a
cavity block" and another that he
"had gone too far". He said on
several occasions that he was responsible for
the killing but subsequently denied it
because he felt "that he would not get a
fair trial". He told another man that he
had killed "the French woman" and
he was wondering "how he could get his
life back again".

CHRISTIANS FEAR GROWTH OF SATANISM IN
ZAMBIA
When President Chiluba endorsed Zambia as
a Christian nation soon after the MMD came to
power in 1991, some people voiced their
opposition to such a declaration. Soon,
however, the criticism died out and the
Christian community in Zambia went full
throttle in its efforts to spreads the faith.
Recent developments in the country, however,
point to the Christians facing a new form of
resistance - Satanism.
Early this year, a couple of youths in the
densely populated province of the Copperbelt
claimed that a group of Satanists was
operating under-ground and recruiting members
at a rate that called for concern. They said
they had been part of the group but decided
to pull out of it because they realised that
devil worshipping was wrong. No one paid much
attention to the two youths' revelation but
three months on, another confession was made
by another young woman in Lusaka who
disclosed that faith in Satan was growing in
the capital and that the Satanists were on an
aggressive campaign to outwit the spread of
Christianity.
More revelations as to the existence of
devil-worship have been made over recent
weeks and now Christians are beginning to
take the issue more seriously, calling for
concerted efforts to counter Satanism. Some
of those who have broken away from the
Satanist groups contend that there is a
deliberate plan by the Satanists to take over
the country by infiltrating various key
organisations, business, the judiciary, the
political field and even the church.
"This message first came in
February," says Christian Unity
Ministries (CUMI), national secretary Timothy
Situmbeko of the alleged plot by Satanists to
take over Zambia and destroy Christian
institutions in Zambia. "We hesitated to
tell the people about it, but continued to
pray. Then early this month it was
repeated." He added that there had been
at least one Satanist planted in some of the
many born-again churches in an effort to
derail the Christian faith and cause
divisions.
Africa Church of God leader, Bishop John
Mambo agrees that there is a plot to destroy
Christianity in Zambia. He contends that many
cults have been formed in the disguise of
churches and already deep divisions are
beginning to show among the Christians.
Police spokesman Standwell Lungu says that
there is no law that would bar Satanists from
practising their faith, but the concern of
many Christians is that the devil's faith is
said to include human sacrifices. Some
reformed devil worshipers have claimed that
the drinking of human blood is part of a
major ritual that Satanists have to practice.
For now, however, no one has come out in the
open yet to confess that he or she practices
Satanism. And those that claim to have
belonged to the faith have not quite been
able to expose those still practising the
faith. For many Christians, however, this is
not an assurance that Satanism is not a
serious threat.
"Christians must be ready for attacks
from the devil," Zambia Episcopal
Conference Secretary General, Father Ignatius
Mwebe says. "The Church as a body has to
fight the prince of darkness. We are his
first target. Goodness is always the target
of evil." Bishop Mambo also said that
the mushrooming of cults was getting out of
hand he wanted government to scrutinise all
the churches to prevent church wars that
could destroy Christianity in the country.
Recent months has seen an increased number of
divisions in various churches, resulting in
splinter groups forming up to follow their
own methods of prayer. Bishop Mambo fears
that if such divisions were allowed to
continue, cults could emerge and Christianity
could become vulnerable to devil worshipers.
The Satanists are said to be very
selective in their recruitment of members.
According to a young woman who recently broke
away from the devil's faith, some Satanists
operate from Christian churches from which
they recruit their members. She said that
those in social or financial problems were
often the main targets for recruitment.
Some political parties too are concerned
about the increased reports of Satanism. The
National Democratic Party (NDP) recently
stated that the MMD government was not doing
enough to curb the spread of Satanism. NDP
Copperbelt Province chairman Isaac Chileshe
said that government should investigate
increasing reports of Satanism taking root in
Zambia. The party contends that the seeds of
Satanism were being planted by foreigners and
it demands that the government deports those
involved.
Police spokesman Lungu says action against
Satanists can only be taken if there is
evidence that some of their practices were,
by Zambian laws, illegal. He said that
investigations had been instituted on some of
the charges made by reformed Satanists but
that no evidence had yet come to light on
which the police could base a prosecution.
For some Christians, the solution to curb
the spread of Satanism is in prayer. The
Baptist Church in Lusaka, for instance, has
embarked on special prayers for those who may
have drifted into Satanism. It is hoped that
the power of prayer will help redirect them
to Christianity. But with the Zambian
constitution categorical that Zambia would be
tolerant of other religions, there is little
much else Christians can do but pray that the
Christian faith will overshadow Satanism.

missing women in Ireland! Kate Madigan
from Kilkenny is missing since May 1998.
Ellen Coss from Dublin is missing since
November 1999 and Eva Brennan is missing
from Dublin since July 1993. Kate Madigan
is on an international missing persons
list but she mysteriously is omitted from
the Garda missing womens list! I believe
this is a deliberate ploy to mislead the
public, so as to hide the true figures
for missing women in Ireland.

Hundreds of child welfare professionals,
including police officers, care workers and
teachers, have been identified as 'extremely
high-risk' paedophiles by an investigation
into internet porn.
The discovery came after US authorities
passed on more than 7,000 names of UK
subscribers to an American-based child porn
website. When police examined a sample of the
most dedicated users, they discovered that
many worked with children.
Investigators knew paedophiles targeted
jobs which brought them into contact with
children, but were shocked by how many
British suspects had been undetected by the
usual checks.
The discovery that many were working in
jobs of the highest sensitivity will send
shock waves through the child protection
world and lead to calls for even more
stringent safeguards.
Investigators now believe as many as 90
police officers have so far been identified
from an initial trawl of 200 of the British
names found in the US. Many of the other
suspects work in other sensitive professions,
often linked to the criminal justice system.
John Carr of the Children's Charities'
Coalition for Internet Safety (CHIS), which
represents all major children's
organisations, including the NSPCC, NCH and
Barnardos, said: 'It's very distressing to
learn that so many policeman are being
arrested for these sorts of offences. It
undermines people's confidence in our ability
to deal with it at all.'
Harry Fletcher, deputy general secretary
of the probation union Napo, said: 'There has
been growing evidence over the past 10 years
that paedophiles have infiltrated careers
that put them in direct contact with
children. This latest evidence suggests we
have to be even more vigilant.'
Specialist child porn investigators,
including officers from the National Hi-Tech
Crime Unit, have initially concentrated on
users who had made more than 10 purchases of
child porn from the internet. They used a US
web 'portal' that gave access to dozens of
sites with titles such as Cyber Lolita, I Am
Fourteen and Child Rape. The sites were run
by porn barons in Russia and Indonesia and
involved abuse committed on captive children.
British involvement in the child porn ring
was so large that police set up Operation Ore
to investigate all 7,200 subscribers in this
country. They have passed on all the names to
the relevant forces for further
investigation; 700 are known to be in
Scotland and 279 in Cambridgeshire. Police
believe at least 5,000 could be considered
'goers' and lead to arrests.
Operation Ore has also uncovered civil
servants, a firefighter and a teacher in
Northern Ireland. Another teacher has been
arrested in Cambridgeshire and suspended from
working with 11-year-olds at a village
school.
One Home Office insider told The Observer
that investigations targeted the most serious
cases, where arrests and convictions were
thought to be relatively straightforward.
These involve images of pre-pubescent
children where suspects cannot claim they
believed they were purchasing adult porn.
The US investigation, Operation Avalanche,
was set up by the United States Postal
Inspection Service, which probes online porn.
It began in Texas and has generated more than
75,000 identities worldwide.
The website portal was run by Thomas and
Janice Reedy, a married couple in Fort Worth,
Texas, who were running an online porn empire
from their suburban mansion which generated
£1 million a month in fees. Both have been
sent to prison.
The Association of Chief Police Officers
(Apco) has warned Ministers that forces do
not have the resources to deal with the
problem. It is awaiting a Home Office
decision on a submission for £2 million of
crisis funding.
A Home Office spokeswoman said Ministers
welcomed Acpo's focus on the issue, but they
had already provided an extra £25 million to
help combat hi-tech crime, including child
porn.
A police spokesman said: 'There are people
up and down this country who are sweating.
Give us their computer, even if it's been
thrown on a skip, and we can quickly nail
them.'

Tribunal
hears allegations of Garda role in death

The
Morris Tribunal has heard of allegations that
two Gardai killed Donegal cattle baron Richie
Barron six years ago. The allegations were
made by a Garda informer, and were heard on
the opening day of the tribunal, which opened
in Donegal town today. The death of Mr Barron
led to a number of Garda inquiries and
eventually ended in the establishment of the
tribunal to investigate allegations of Garda
corruption. The council also heard how two
Gardai did not give any account of their
movements on the night of Barron's death, and
of allegations against two named Gardai that
they conspired to plant guns and ammunition.
A central group in the events leading to the
tribunal's establishment, the McBrearty
family from Raphoe are not being represented
at the tribunal, as they are claim they
cannot afford legal representation and are
unhappy with the terms of reference of the
tribunal. It is expected to sit for two
years.
