Judge Curtin
The
trial of the Circuit Court judge Brian Curtin on
charges of possessing child pornography has
collapsed.
Judge
Curtin has been found not guilty by direction of
the trial judge Carroll Moran. The accused had
pleaded not guilty to the charges.
Judge
Moran found that gardaí raided Mr Curtin's home
after the search warrant had expired. He said the
State had to have been aware that the warrant had
expired.
In
his seven page written judgement, Judge Moran
described the submissions made by the prosecution
on the validity of the search warrant as
'untenable and nonsensical'.
He
said the prosecution must have known or at least
ought to have known that on any reasonable
interpretation of the issues any judge in any
court would have excluded the relevant evidence.
Judge
Moran said the law was crystal clear and the
issue could not be simpler.
He
said it was wrong for the prosecution to bring
this case to trial when they knew or ought to
have known that the warrant had expired and the
evidence collected as a result of the execution
of the warrant would have been inadmissible.
Questioned
about the court ruling in relation to the
warrant, a garda spokesman said they accepted the
judgement of the court.
The
spokesman said garda management will be examining
the judgement in relation to how it affects the
gardaí operationally."

How do you get a powerful and influential
paedophile off the hook and have him walk free
from court after being charged with possession of
images of under-age children being sexually
abused -
Answer - Get the Garda (Irish Police) to
serve a search warrant in a manner, which will
give the presiding judge the excuse to throw the
case out of court on a legal
"technicality"! Thus a potentially
dangerous paedophile need not face the difficult
questions in an open court!
I wonder if I am the only person who can
see what has more than likely taken place in the
case of Judge Curtain, who was caught in
possession of images of children being abused!
Is this scenario not the correct one?
When a wealthy and influential Irish
person is accused of a crime and a date is set
when he or she will appear in court on the
charges, elitist hidden societies who can call
upon persons within all of the institutions of
the Irish State, especially the Garda and the
judiciary, to pull together and set events in
motion that will eventually end up in the case
being thrown out of court on the basis of a legal
technicality! And as in the
Judge Curtain case, he is deemed innocent of all
the charges, which were brought against him!
This would
not be allowed in a Banana Republic but it
regularly takes place in Ireland!

(a) Nora Wall,
a former nun , accused of instructing a man to
rape a child in her care whilst she looked on,
walked free on a legal technicality!
(b) A suspect
in the Wellington Terrace murders and
disappearances in Cork 1995 ,walked free on a
legal "technicality".
(c) We all are aware of the
numerous cases when IRA subjects were denied
extradition to the UK when the Garda submitted
the legal papers to the presiding judge in
manner, which were claimed to be unlawful within
the antiquated laws that exist in the Irish
Republic!

"Surely - the
first thing, which springs to my mind when I
consider this case is: - A person who has been
accused of paedophilia is allowed to walk free,
not because he has been found not guilty, but
because of a mistake (deliberate or otherwise)
made by police officers or the prosecuting
counsels!
It is obvious to a legal illiterate such as
myself that a probable criminal gets off
scot-free and is not made accountable for his
crimes! This is not law but a farce!
